Prostorov\u00e1 data, kter\u00e1 mus\u00ed b\u00fdt v\u017edy p\u0159edlo\u017eena p\u0159\u00edslu\u0161n\u00e9mu archivu k&nbsp;v\u00fdb\u011bru, jsou vyjmenov\u00e1na v&nbsp;p\u0159\u00edloze \u010d. 2. AZ, konkr\u00e9tn\u011b se jedn\u00e1 o:<\/p>\n\n\n\n<p><var><strong>4.<\/strong><\/var>&nbsp;Dokumenty geodetick\u00e9 a kartografick\u00e9, katastry maj\u00ed za podm\u00ednek stanoven\u00fdch t\u00edmto z\u00e1konem tak\u00e9<\/p>\n\n\n\n<p><var><strong>a)<\/strong><\/var>&nbsp;obchodn\u00ed spole\u010dnosti a dru\u017estva s v\u00fdjimkou bytov\u00fdch dru\u017estev, pokud jde o dokumenty uveden\u00e9 v p\u0159\u00edloze \u010d. 1 k tomuto z\u00e1konu,<\/p>\n\n\n\n<p><var><strong>b)<\/strong><\/var>&nbsp;politick\u00e9 strany, politick\u00e1 hnut\u00ed, spolky, odborov\u00e9 organizace, organizace zam\u011bstnavatel\u016f, c\u00edrkve a n\u00e1bo\u017eensk\u00e9 spole\u010dnosti, profesn\u00ed komory, nadace, nada\u010dn\u00ed fondy, \u00fastavy a obecn\u011b prosp\u011b\u0161n\u00e9 spole\u010dnosti,<\/p>\n\n\n\n<p><var><strong>c)<\/strong><\/var>&nbsp;not\u00e1\u0159i, pokud jde o dokumenty uveden\u00e9 v p\u0159\u00edloze \u010d. 1 k tomuto z\u00e1konu,<\/p>\n\n\n\n<p>(d\u00e1le jen \u201esoukromopr\u00e1vn\u00ed p\u016fvodci\u201c).<\/p>\n\n\n\n<p><var><strong>(3)<\/strong><\/var>&nbsp;Povinnost uchov\u00e1vat dokumenty a umo\u017enit v\u00fdb\u011br archiv\u00e1li\u00ed maj\u00ed d\u00e1le pr\u00e1vn\u00ed n\u00e1stupci ve\u0159ejnopr\u00e1vn\u00edch a soukromopr\u00e1vn\u00edch p\u016fvodc\u016f, jde-li o dokumenty, ke kter\u00fdm m\u011bli tuto povinnost ji\u017e tito p\u016fvodci.<\/p>\n\n\n\n<p><var><strong>(4)<\/strong><\/var>&nbsp;Povinnost uchov\u00e1vat dokumenty a umo\u017enit v\u00fdb\u011br archiv\u00e1li\u00ed maj\u00ed d\u00e1le podnikatel\u00e9, kter\u00fdm bylo ud\u011bleno st\u00e1tn\u00ed povolen\u00ed k provozov\u00e1n\u00ed \u017eivnosti veden\u00ed spisovny (d\u00e1le jen \u201ekoncese k veden\u00ed spisovny\u201c), jde-li o dokumenty, ke kter\u00fdm maj\u00ed tuto povinnost ve\u0159ejnopr\u00e1vn\u00ed p\u016fvodci, soukromopr\u00e1vn\u00ed p\u016fvodci nebo jejich pr\u00e1vn\u00ed n\u00e1stupci a kter\u00e9 byly ve\u0159ejnopr\u00e1vn\u00edmi p\u016fvodci, soukromopr\u00e1vn\u00edmi p\u016fvodci nebo jejich pr\u00e1vn\u00edmi n\u00e1stupci t\u011bmto podnikatel\u016fm p\u0159ed\u00e1ny k zaji\u0161t\u011bn\u00ed odborn\u00e9 spr\u00e1vy.<\/p>\n\n\n\n<p><var><strong>(5)<\/strong><\/var>&nbsp;V p\u0159\u00edpad\u011b dokument\u016f v digit\u00e1ln\u00ed podob\u011b se jejich uchov\u00e1v\u00e1n\u00edm rozum\u00ed rovn\u011b\u017e zaji\u0161t\u011bn\u00ed v\u011brohodnosti p\u016fvodu dokument\u016f, neporu\u0161itelnosti jejich obsahu a \u010ditelnosti, tvorba a spr\u00e1va metadat n\u00e1le\u017eej\u00edc\u00edch k t\u011bmto dokument\u016fm v souladu s t\u00edmto z\u00e1konem a p\u0159ipojen\u00ed \u00fadaj\u016f prokazuj\u00edc\u00edch existenci dokumentu v \u010dase. Tyto vlastnosti mus\u00ed b\u00fdt zachov\u00e1ny do doby proveden\u00ed v\u00fdb\u011bru archiv\u00e1li\u00ed.<\/p>\n\n\n\n<p><var><strong>(6)<\/strong><\/var>&nbsp;V\u00fdb\u011br archiv\u00e1li\u00ed prov\u00e1d\u00ed archiv podle sv\u00e9 p\u016fsobnosti (d\u00e1le jen &#8222;p\u0159\u00edslu\u0161n\u00fd archiv&#8220;).<\/p>\n\n\n\n<p><var><strong>(7)<\/strong><\/var>&nbsp;Povinnost uchov\u00e1vat dokumenty a umo\u017enit v\u00fdb\u011br archiv\u00e1li\u00ed pro poskytovatele zdravotn\u00edch slu\u017eeb, kte\u0159\u00ed jsou ve\u0159ejnopr\u00e1vn\u00edmi nebo soukromopr\u00e1vn\u00edmi p\u016fvodci, v p\u0159\u00edpad\u011b zdravotnick\u00e9 dokumentace stanov\u00ed jin\u00e9 pr\u00e1vn\u00ed p\u0159edpisy upravuj\u00edc\u00ed veden\u00ed a uchov\u00e1v\u00e1n\u00ed zdravotnick\u00e9 dokumentace<strong>.<\/strong><\/p>\n\n\n\n<h3>\u00a7 4<\/h3>\n\n\n\n<p>Krit\u00e9riem v\u00fdb\u011bru archiv\u00e1li\u00ed je trval\u00e1 hodnota dokumentu vzhledem k<\/p>\n\n\n\n<p><var><strong>a)<\/strong><\/var>&nbsp;dob\u011b vzniku,<\/p>\n\n\n\n<p><var><strong>b)<\/strong><\/var>&nbsp;obsahu,<\/p>\n\n\n\n<p><var><strong>c)<\/strong><\/var>&nbsp;p\u016fvodu,<\/p>\n\n\n\n<p><var><strong>d)<\/strong><\/var>&nbsp;vn\u011bj\u0161\u00edm znak\u016fm.<\/p>\n\n\n\n<h3>V\u00fdb\u011br archiv\u00e1li\u00ed ve skarta\u010dn\u00edm \u0159\u00edzen\u00ed<\/h3>\n\n\n\n<h3>\u00a7 7<\/h3>\n\n\n\n<p><var><strong>(1)<\/strong><\/var>&nbsp;V\u00fdb\u011br archiv\u00e1li\u00ed ve skarta\u010dn\u00edm \u0159\u00edzen\u00ed prov\u00e1d\u00ed p\u0159\u00edslu\u0161n\u00fd archiv z dokument\u016f ve\u0159ejnopr\u00e1vn\u00edho p\u016fvodce, z dokument\u016f jeho pr\u00e1vn\u00edho p\u0159edch\u016fdce a z dokument\u016f soukromopr\u00e1vn\u00edho p\u016fvodce, m\u00e1-li z\u0159\u00edzen soukrom\u00fd archiv.<\/p>\n\n\n\n<p><var><strong>(2)<\/strong><\/var>&nbsp;V\u00fdb\u011br archiv\u00e1li\u00ed ve skarta\u010dn\u00edm \u0159\u00edzen\u00ed prov\u00e1d\u00ed p\u0159\u00edslu\u0161n\u00fd archiv z dokument\u016f soukromopr\u00e1vn\u00edho p\u016fvodce, po\u017e\u00e1d\u00e1-li o to soukromopr\u00e1vn\u00ed p\u016fvodce.<\/p>\n\n\n\n<p><var><strong>(3)<\/strong><\/var>&nbsp;Skarta\u010dn\u00ed \u0159\u00edzen\u00ed je postup, p\u0159i kter\u00e9m se vy\u0159azuj\u00ed dokumenty, jim\u017e uplynuly skarta\u010dn\u00ed lh\u016fty a je\u017e jsou nad\u00e1le nepot\u0159ebn\u00e9 pro \u010dinnost p\u016fvodce.<\/p>\n\n\n\n<p><var><strong>(4)<\/strong><\/var>&nbsp;Za \u0159\u00e1dn\u00e9 proveden\u00ed skarta\u010dn\u00edho \u0159\u00edzen\u00ed odpov\u00edd\u00e1 p\u016fvodce nebo jeho pr\u00e1vn\u00ed n\u00e1stupce. Tyto subjekty jsou povinny umo\u017enit p\u0159\u00edslu\u0161n\u00e9mu archivu dohled na prov\u00e1d\u011bn\u00ed skarta\u010dn\u00edho \u0159\u00edzen\u00ed a v\u00fdb\u011br archiv\u00e1li\u00ed ve skarta\u010dn\u00edm \u0159\u00edzen\u00ed.<\/p>\n\n\n\n<p>\u00a7 8<\/p>\n\n\n\n<p><var><strong>(1)<\/strong><\/var>&nbsp;Skarta\u010dn\u00ed \u0159\u00edzen\u00ed se provede v kalend\u00e1\u0159n\u00edm roce n\u00e1sleduj\u00edc\u00edm po uplynut\u00ed skarta\u010dn\u00ed lh\u016fty dokumentu. Skarta\u010dn\u00ed \u0159\u00edzen\u00ed m\u016f\u017ee b\u00fdt po dohod\u011b s p\u0159\u00edslu\u0161n\u00fdm archivem provedeno i pozd\u011bji, pokud subjekt uveden\u00fd v \u00a7 7 odst. 4 dokumenty pot\u0159ebuje pro dal\u0161\u00ed vlastn\u00ed \u010dinnost.<\/p>\n\n\n\n<p><var><strong>(2)<\/strong><\/var>&nbsp;Skarta\u010dn\u00ed \u0159\u00edzen\u00ed se prov\u00e1d\u00ed na z\u00e1klad\u011b skarta\u010dn\u00edho n\u00e1vrhu. Skarta\u010dn\u00ed n\u00e1vrh za\u0161le subjekt uveden\u00fd v \u00a7 7 odst. 4 p\u0159\u00edslu\u0161n\u00e9mu archivu k posouzen\u00ed a k proveden\u00ed v\u00fdb\u011bru archiv\u00e1li\u00ed.<\/p>\n\n\n\n<p><var><strong>(3)<\/strong><\/var>&nbsp;Skarta\u010dn\u00ed \u0159\u00edzen\u00ed se d\u00e1le provede v\u017edy p\u0159ed z\u00e1nikem ve\u0159ejnopr\u00e1vn\u00edho p\u016fvodce. Byl-li dokument vybr\u00e1n jako archiv\u00e1lie, p\u016fvodce jej po v\u00fdb\u011bru archiv\u00e1li\u00ed opat\u0159\u00ed dolo\u017ekou, v n\u00ed\u017e uvede druh tajemstv\u00ed v dokumentu obsa\u017een\u00fd. Ochrana obchodn\u00edho, bankovn\u00edho nebo obdobn\u00e9ho tajemstv\u00ed nen\u00ed vybr\u00e1n\u00edm dokument\u016f za archiv\u00e1lie dot\u010dena.<\/p>\n\n\n\n<p><var><strong>(3)<\/strong><\/var>&nbsp;K v\u00fdb\u011bru archiv\u00e1li\u00ed z dokument\u016f obsahuj\u00edc\u00edch osobn\u00ed \u00fadaje a k jejich trval\u00e9mu uchov\u00e1v\u00e1n\u00ed se nevy\u017eaduje souhlas fyzick\u00e9 osoby podle zvl\u00e1\u0161tn\u00edho pr\u00e1vn\u00edho p\u0159edpisu.<strong><sup><a href=\"https:\/\/www.zakonyprolidi.cz\/cs\/2004-499#f2629301\">5)<\/a><\/sup><\/strong><\/p>\n\n\n\n<p><var><strong>(4)<\/strong><\/var>&nbsp;P\u0159i v\u00fdb\u011bru archiv\u00e1li\u00ed jsou osoby prov\u00e1d\u011bj\u00edc\u00ed v\u00fdb\u011br archiv\u00e1li\u00ed opr\u00e1vn\u011bny vstupovat s v\u011bdom\u00edm p\u016fvodce nebo vlastn\u00edka dokumentu do objekt\u016f, na pozemky a do jin\u00fdch prostor, pokud nelze v\u00fdb\u011br archiv\u00e1li\u00ed prov\u00e9st jin\u00fdm zp\u016fsobem. Pokud dokument nelze p\u0159ev\u00e9st do stanoven\u00e9ho datov\u00e9ho form\u00e1tu a opat\u0159it ho metadaty, a to ani ve spolupr\u00e1ci s p\u0159\u00edslu\u0161n\u00fdm archivem, dokument jeho p\u016fvodce p\u0159evede do analogov\u00e9 podoby.<\/p>\n\n\n\n<p><var><strong>(6)<\/strong><\/var>&nbsp;Dokumenty se p\u0159edkl\u00e1daj\u00ed k v\u00fdb\u011bru archiv\u00e1li\u00ed p\u0159\u00edslu\u0161n\u00e9mu archivu bez ohledu na m\u00edsto jejich ulo\u017een\u00ed.<\/p>\n\n\n\n<p>\u00a7 14<\/p>\n\n\n\n<p><var><strong>(1)<\/strong><\/var>&nbsp;Zam\u011bstnanci spr\u00e1vn\u00edch \u00fa\u0159ad\u016f na \u00faseku archivnictv\u00ed a v\u00fdkonu spisov\u00e9 slu\u017eby, zam\u011bstnanci archiv\u016f a jejich z\u0159izovatel\u00e9 jsou povinni zachov\u00e1vat ml\u010denlivost o v\u0161ech skute\u010dnostech, kter\u00e9 se dozv\u011bd\u011bli p\u0159i v\u00fdkonu \u010dinnost\u00ed podle tohoto z\u00e1kona. T\u00e9to povinnosti mohou b\u00fdt zpro\u0161t\u011bni p\u0159\u00edslu\u0161n\u00fdm spr\u00e1vn\u00edm \u00fa\u0159adem na \u00faseku archivnictv\u00ed a v\u00fdkonu spisov\u00e9 slu\u017eby; zpro\u0161t\u011bn\u00ed mus\u00ed b\u00fdt p\u00edsemn\u00e9 s uveden\u00edm rozsahu a \u00fa\u010delu. Povinnost ml\u010denlivosti stanoven\u00e1 zvl\u00e1\u0161tn\u00edmi pr\u00e1vn\u00edmi p\u0159edpisy<strong><sup><a href=\"https:\/\/www.zakonyprolidi.cz\/cs\/2004-499#f2629302\">6)<\/a><\/sup><\/strong>&nbsp;t\u00edm nen\u00ed dot\u010dena.<\/p>\n\n\n\n<p><var><strong>(2)<\/strong><\/var>&nbsp;Je-li z\u0159izovatelem archivu pr\u00e1vnick\u00e1 osoba, vztahuje se povinnost zachov\u00e1vat ml\u010denlivost podle odstavce 1 na fyzick\u00e9 osoby, kter\u00e9 se vzhledem ke sv\u00e9mu zam\u011bstn\u00e1n\u00ed, funkci nebo obdobn\u00e9mu postaven\u00ed v t\u00e9to pr\u00e1vnick\u00e9 osob\u011b s chr\u00e1n\u011bn\u00fdmi \u00fadaji sezn\u00e1mily.<\/p>\n\n\n\n<p><var><strong>(3)<\/strong><\/var>&nbsp;Povinnost zachov\u00e1vat ml\u010denlivost trv\u00e1 i po skon\u010den\u00ed slu\u017eebn\u00edho pom\u011bru, pracovn\u011bpr\u00e1vn\u00edho nebo jin\u00e9ho obdobn\u00e9ho vztahu.<\/p>\n\n\n\n<p>\u00a7 15<\/p>\n\n\n\n<p><var><strong>(1)<\/strong><\/var>&nbsp;Dokumenty vybran\u00e9 jako archiv\u00e1lie a ur\u010den\u00e9 do p\u00e9\u010de archivu p\u0159ed\u00e1 p\u016fvodce nebo vlastn\u00edk dokumentu na z\u00e1klad\u011b protokolu o proveden\u00e9m skarta\u010dn\u00edm \u0159\u00edzen\u00ed nebo protokolu o proveden\u00e9m v\u00fdb\u011bru archiv\u00e1li\u00ed mimo skarta\u010dn\u00ed \u0159\u00edzen\u00ed ur\u010den\u00e9mu archivu. Nen\u00ed-li z\u0159izovatel archivu dr\u017eitelem opr\u00e1vn\u011bn\u00ed k ukl\u00e1d\u00e1n\u00ed archiv\u00e1li\u00ed v digit\u00e1ln\u00ed podob\u011b, archiv\u00e1lie v digit\u00e1ln\u00ed podob\u011b n\u00e1le\u017eej\u00edc\u00ed do jeho p\u00e9\u010de se na z\u00e1klad\u011b p\u00edsemn\u00e9 dohody z\u0159izovatel\u016f archiv\u016f ulo\u017e\u00ed v N\u00e1rodn\u00edm archivu nebo v archivu, jeho\u017e z\u0159izovateli je ud\u011bleno opr\u00e1vn\u011bn\u00ed k ukl\u00e1d\u00e1n\u00ed archiv\u00e1li\u00ed v digit\u00e1ln\u00ed podob\u011b (d\u00e1le jen \u201edigit\u00e1ln\u00ed archiv\u201c). Neuzav\u0159e-li z\u0159izovatel archivu dohodu o ulo\u017een\u00ed archiv\u00e1li\u00ed, archiv\u00e1lie v digit\u00e1ln\u00ed podob\u011b n\u00e1le\u017eej\u00edc\u00ed do jeho p\u00e9\u010de se ulo\u017e\u00ed v N\u00e1rodn\u00edm archivu. P\u0159\u00edslu\u0161nost archivu, do jeho\u017e p\u00e9\u010de archiv\u00e1lie v digit\u00e1ln\u00ed podob\u011b n\u00e1le\u017e\u00ed, nen\u00ed jej\u00edm ulo\u017een\u00edm v N\u00e1rodn\u00edm archivu nebo v digit\u00e1ln\u00edm archivu dot\u010dena.<\/p>\n\n\n\n<p><var><strong>(4)<\/strong><\/var>&nbsp;P\u0159\u00edslu\u0161n\u00fd archiv m\u016f\u017ee na z\u00e1klad\u011b \u017e\u00e1dosti p\u016fvodce vydat trval\u00fd skarta\u010dn\u00ed souhlas na j\u00edm stanoven\u00fd druh dokument\u016f, kter\u00e9 lze zni\u010dit i bez v\u00fdb\u011bru archiv\u00e1li\u00ed. Nedodr\u017e\u00ed-li p\u016fvodce podm\u00ednky stanoven\u00e9 v trval\u00e9m skarta\u010dn\u00edm souhlasu, p\u0159\u00edslu\u0161n\u00fd archiv m\u016f\u017ee trval\u00fd skarta\u010dn\u00ed souhlas zru\u0161it z moci \u00fa\u0159edn\u00ed. V p\u0159\u00edpad\u011b z\u00e1niku p\u016fvodce vydan\u00fd trval\u00fd skarta\u010dn\u00ed souhlas nep\u0159ech\u00e1z\u00ed na pr\u00e1vn\u00edho n\u00e1stupce.<\/p>\n\n\n\n<h3>P\u0159ehled pr\u00e1vn\u00edch p\u0159edpis\u016f k&nbsp;prostorov\u00fdm dat\u016fm<\/h3>\n\n\n\n<p>V&nbsp;\u010cesk\u00e9 republice dosud chyb\u00ed n\u00e1rodn\u00ed pr\u00e1vn\u00ed p\u0159edpis, kter\u00fd by ucelen\u011b a systematicky zakotvil n\u00e1rodn\u00ed infrastrukturu pro prostorov\u00e9 informace. Vzhledem k&nbsp;mimo\u0159\u00e1dn\u00e9mu v\u00fdznamu prostorov\u00fdch informac\u00ed navrhla Evropsk\u00e1 komise z\u0159\u00eddit Infrastrukturu pro prostorov\u00e9 informace v&nbsp;Evropsk\u00e9m spole\u010denstv\u00ed, kter\u00e1 m\u00e1 napom\u00e1hat tvorb\u011b politik a \u010dinnost\u00ed s&nbsp;p\u0159\u00edm\u00fdm nebo nep\u0159\u00edm\u00fdm vlivem na \u017eivotn\u00ed prost\u0159ed\u00ed.<\/p>\n\n\n\n<p>Obecn\u00e1 pravidla byla stanovena Sm\u011brnic\u00ed Evropsk\u00e9ho parlamentu a Rady 2007\/2\/ES, o z\u0159\u00edzen\u00ed Infrastruktury pro prostorov\u00e9 informace v&nbsp;Evropsk\u00e9m spole\u010denstv\u00ed (INSPIRE). Sm\u011brnice INSPIRE byla transponov\u00e1na v&nbsp;\u010cR z\u00e1konem \u010d. 380\/2009 Sb., kter\u00fdm se m\u011bn\u00ed z\u00e1k. \u010d. 123\/1998 Sb., o pr\u00e1vu na informace o \u017eivotn\u00edm prost\u0159ed\u00ed, ve zn\u011bn\u00ed pozd\u011bj\u0161\u00edch p\u0159edpis\u016f, a z\u00e1k. \u010d. 200\/1994 Sb., o zem\u011bm\u011b\u0159ictv\u00ed. Ministerstvo \u017eivotn\u00edho prost\u0159ed\u00ed touto novelou z\u0159izuje N\u00e1rodn\u00ed geoport\u00e1l INSPIRE, kter\u00fd \u0161irok\u00e9 ve\u0159ejnosti zp\u0159\u00edstup\u0148uje prostorov\u00e1 data t\u00fdkaj\u00edc\u00ed se alespo\u0148 jednoho z&nbsp;t\u00e9mat p\u0159\u00edlohy sm\u011brnice. Slu\u017eby na geoport\u00e1lu umo\u017e\u0148uj\u00ed u\u017eivateli vyhled\u00e1vat, prohl\u00ed\u017eet a stahovat data. V&nbsp;pr\u016fb\u011bhu implementace princip\u016f sm\u011brnice INSPIRE do n\u00e1rodn\u00edho prost\u0159ed\u00ed se potvrdilo, \u017ee je \u00fa\u010deln\u00e9 roz\u0161\u00ed\u0159it principy INSPIRE nad r\u00e1mec 34 t\u00e9mat prostorov\u00fdch dat sm\u011brnic\u00ed INSPIRE \u0159e\u0161en\u00fdch a na jejich z\u00e1klad\u011b pak n\u00e1rodn\u00ed infrastrukturu pro prostorov\u00e9 informace (NIPI) koordinovan\u011b rozv\u00edjet.<\/p>\n\n\n\n<p>Tvorba, poskytov\u00e1n\u00ed, spr\u00e1va, sd\u00edlen\u00ed i vyu\u017e\u00edv\u00e1n\u00ed prostorov\u00fdch informac\u00ed prob\u00edh\u00e1 v&nbsp;sou\u010dasn\u00e9 dob\u011b rozt\u0159\u00ed\u0161t\u011bn\u011b a bez dostate\u010dn\u00e9 koordinace z&nbsp;centr\u00e1ln\u00ed \u00farovn\u011b \u2013 chyb\u00ed gestor. V&nbsp;\u010cR nen\u00ed k&nbsp;dispozici ucelen\u00fd p\u0159ehled existuj\u00edc\u00edch prostorov\u00fdch informac\u00ed ani slu\u017eeb nad nimi poskytovan\u00fdch.&nbsp; V&nbsp;praxi doch\u00e1z\u00ed k&nbsp;opakovan\u00e9mu po\u0159izov\u00e1n\u00ed obdobn\u00fdch \u010di dokonce stejn\u00fdch prostorov\u00fdch informac\u00ed (duplicita). Na druh\u00e9 stran\u011b n\u011bkter\u00e9 v\u00fdznamn\u00e9 prostorov\u00e9 informace chyb\u00ed (nap\u0159. informace o bytech). Neexistuje jednotn\u00e1 koordinace \u0159\u00edzen\u00ed kvality dat a slu\u017eeb nad prostorov\u00fdmi daty. V\u011bt\u0161ina pr\u00e1vn\u00edch p\u0159edpis\u016f neuv\u00e1d\u00ed v\u00fdslovnou povinnost ke zpracov\u00e1n\u00ed, sd\u00edlen\u00ed \u010di poskytov\u00e1n\u00ed prostorov\u00fdch dat, ale pouze zpracov\u00e1n\u00ed informac\u00ed. Je t\u0159eba respektovat z\u00e1v\u011bry dokument\u016f vze\u0161l\u00fdch z&nbsp;dosavadn\u00edch prac\u00ed na Strategii rozvoje infrastruktury pro prostorov\u00e9 informace v&nbsp;\u010cR do roku 2020 (GeoInfoStrategie \u2013 usnesen\u00ed vl\u00e1dy \u010cR \u010d. 815 ze dne 8. \u0159\u00edjna 2014) a rady expert\u016f z&nbsp;oblasti geodezie a geoinformatiky, jako\u017e i principy eGovernmentu a Smart Administration.Standardizaci a posun v&nbsp;t\u00e9to oblasti lze p\u0159edpokl\u00e1dat od p\u0159ipravovan\u00e9 Geoinfostrategie 2020+.<\/p>\n\n\n\n<p>V&nbsp;oblasti prostorov\u00fdch dat mus\u00ed b\u00fdt nejprve z\u0159ejm\u00e9 politick\u00e9 zad\u00e1n\u00ed, kter\u00e9 jasn\u011b ozna\u010d\u00ed subjekty ve\u0159ejn\u00e9 spr\u00e1vy, kter\u00e9 budou odpov\u011bdn\u00e9 za koordinaci rozvoje, i m\u00edru zapojen\u00ed soukrom\u00e9ho sektoru. Technick\u00e9 \u0159e\u0161en\u00ed se v&nbsp;sou\u010dasnosti jev\u00ed jako pom\u011brn\u011b jasn\u00e9 a v&nbsp;r\u00e1mci digitalizace ve\u0159ejn\u00e9 spr\u00e1vy i provediteln\u00e9. Povinnost data sd\u00edlet a poskytovat nen\u00ed legislativn\u011b jednotn\u011b definov\u00e1na, respektive jednotliv\u00e9 pr\u00e1vn\u00ed p\u0159edpisy neu\u017e\u00edvaj\u00ed v\u00fdslovn\u011b pojem sd\u00edlen\u00ed nebo poskytov\u00e1n\u00ed, i kdy\u017e obsah jejich ustanoven\u00ed lze pod pojmy sd\u00edlen\u00ed \u010di poskytov\u00e1n\u00ed do zna\u010dn\u00e9 m\u00edry pod\u0159adit. Tato m\u00edra se u jednotliv\u00fdch pr\u00e1vn\u00edch p\u0159edpis\u016f li\u0161\u00ed a je t\u0159eba nadefinovat, co se rozum\u00ed sd\u00edlen\u00edm a co poskytov\u00e1n\u00edm.<\/p>\n\n\n\n<p>Sd\u00edlen\u00ed je zpravidla zaji\u0161t\u011bn\u00ed p\u0159\u00edstupu k&nbsp;dat\u016fm a informac\u00edm pro v\u00edce u\u017eivatel\u016f nez\u00e1visle na sob\u011b, p\u0159i sd\u00edlen\u00ed soubor\u016f nap\u0159. modelem peer\u2013tu\u2013peer, (Pozn.: rovn\u00fd s&nbsp;rovn\u00fdm nebo klient-klient, jednotliv\u00ed klienti\/u\u017eivatel\u00e9 spolu komunikuj\u00ed p\u0159\u00edmo; opakem je klient-server, kde klienti komunikuj\u00ed v\u017edy s&nbsp;centr\u00e1ln\u00edm serverem), u\u017eivatel\u00e9 maj\u00ed mo\u017enost slo\u017eky stahovat i nahr\u00e1vat, bez nutnosti po\u017e\u00e1dat o data jejich po\u0159izovatele \u010di spr\u00e1vce.<\/p>\n\n\n\n<p>Poskytovat znamen\u00e1 zejm\u00e9na d\u00e1vat, sk\u00fdtat \u2013 \u010dili jednosm\u011brn\u00e1 z\u00e1le\u017eitost, kdy dr\u017eitel dat p\u0159ed\u00e1 jejich soubor dal\u0161\u00edmu subjektu, a\u0165 u\u017e na \u017e\u00e1dost nebo ze z\u00e1kona.<\/p>\n\n\n\n<p>Je t\u0159eba konstatovat, \u017ee \u0159ada pr\u00e1vn\u00edch p\u0159edpis\u016f je t\u011b\u017eko za\u0159aditeln\u00fdch \u2013 nap\u0159. R\u00daIAN (registr \u00fazemn\u00ed identifikace, adres a nemovitost\u00ed), z\u0159\u00edzen\u00fd z\u00e1konem \u010d. 111\/2009 Sb., o z\u00e1kladn\u00edch registrech. Jedn\u00e1 se o typick\u00fd registr, kter\u00fd je na pomez\u00ed sd\u00edlen\u00ed a poskytov\u00e1n\u00ed dat. P\u0159eva\u017euje n\u00e1zor, \u017ee v&nbsp;tomto p\u0159\u00edpad\u011b doch\u00e1z\u00ed ke sd\u00edlen\u00ed prostorov\u00fdch dat. V p\u0159\u00edpad\u011b povinnosti poskytovat prostorov\u00e1 data ve\u0159ejnosti se m\u016f\u017ee jednat o pr\u00e1vo na informace.<\/p>\n\n\n\n<p>Pr\u00e1vn\u00ed p\u0159edpisy z&nbsp;oblasti prostorov\u00fdch dat lze rozd\u011blit na: kl\u00ed\u010dov\u00e9, podp\u016frn\u00e9 a m\u00e9n\u011b v\u00fdznamn\u00e9.<\/p>\n\n\n\n<p>Kl\u00ed\u010dov\u00e9 pr\u00e1vn\u00ed p\u0159edpisy \u2013 bu\u010f obsahuj\u00ed pr\u00e1vn\u00ed \u00fapravu t\u00fdkaj\u00edc\u00ed se prostorov\u00fdch dat ve velk\u00e9 m\u00ed\u0159e, obsahuj\u00ed duplicity \u010di jin\u00e9 z\u00e1sadn\u00ed probl\u00e9my, kter\u00e9 je t\u0159eba odstranit anebo naopak sk\u00fdtaj\u00ed velk\u00fd potenci\u00e1l k&nbsp;dal\u0161\u00edmu rozvoji NIPI, by\u0165 se (zat\u00edm) prostorov\u00fdmi daty nezab\u00fdvaj\u00ed. To je nap\u0159. z\u00e1kon \u010d. 2\/1969 Sb., o z\u0159\u00edzen\u00ed ministerstev a jin\u00fdch \u00fast\u0159edn\u00edch org\u00e1n\u016f st\u00e1tn\u00ed spr\u00e1vy (kompeten\u010dn\u00ed z\u00e1kon), jeho\u017e zm\u011bna je nutn\u00e1 pro ur\u010den\u00ed gestora za oblast prostorov\u00fdch dat a informac\u00ed.<\/p>\n\n\n\n<p>Podp\u016frn\u00e9 pr\u00e1vn\u00ed p\u0159edpisy \u2013 obsahuj\u00ed alespo\u0148 n\u011bjakou \u00fapravu t\u00fdkaj\u00edc\u00ed se prostorov\u00fdch dat \u010di informac\u00ed, resp. agendy s&nbsp;prostorov\u00fdm potenci\u00e1lem.<\/p>\n\n\n\n<p>M\u00e9n\u011b v\u00fdznamn\u00e9 pr\u00e1vn\u00ed p\u0159edpisy \u2013 se prostorov\u00fdch dat a informac\u00ed nedot\u00fdkaj\u00ed v\u016fbec nebo jen velmi okrajov\u011b.<\/p>\n\n\n\n<p>V\u011bt\u0161ina pr\u00e1vn\u00edch p\u0159edpis\u016f neuv\u00e1d\u00ed v\u00fdslovnou povinnost ke zpracov\u00e1n\u00ed, sd\u00edlen\u00ed \u010di poskytov\u00e1n\u00ed prostorov\u00fdch dat, n\u00fdbr\u017e pouze zpracov\u00e1v\u00e1n\u00ed informac\u00ed. V&nbsp;sou\u010dasn\u00e9 dob\u011b jsou respektov\u00e1ny z\u00e1v\u011bry dokument\u016f vze\u0161l\u00fdch z&nbsp;dosavadn\u00edch prac\u00ed na Strategii rozvoje infrastruktury pro prostorov\u00e9 informace v&nbsp;\u010cR do roku 2020 (GeoInfoStrategie), rady expert\u016f z&nbsp;oblasti geod\u00e9zie a geoinformatiky, v\u010d. princip\u016f eGovernmentu a Smart Administration.<\/p>\n\n\n\n<p><a>Anal\u00fdza kl\u00ed\u010dov\u00fdch pr\u00e1vn\u00edch p\u0159edpis\u016f<\/a><\/p>\n\n\n\n<p><strong>Z\u00e1kon \u010d. 2\/1969 Sb., o z\u0159\u00edzen\u00ed ministerstev a jin\u00fdch \u00fast\u0159edn\u00edch org\u00e1n\u016f st\u00e1tn\u00ed spr\u00e1vy<\/strong> (tzv. kompeten\u010dn\u00ed z\u00e1kon) pr\u00e1vn\u00ed p\u0159edpis, r\u00e1mcov\u011b stanovuje p\u016fsobnost jednotliv\u00fdch ministerstev, obsahuje z\u00e1sady, kter\u00e9 se vztahuj\u00ed na v\u0161echny \u00fast\u0159edn\u00ed spr\u00e1vn\u00ed \u00fa\u0159ady. Neupravuje zp\u016fsob tvorby prostorov\u00fdch dat a informac\u00ed, spr\u00e1vu prostorov\u00fdch dat, podm\u00ednky poskytov\u00e1n\u00ed \u010di sd\u00edlen\u00ed.<br>Jde o jeden z&nbsp;kl\u00ed\u010dov\u00fdch pr\u00e1vn\u00edch p\u0159edpis\u016f \u010cR, kde by bylo vhodn\u00e9 jasn\u011b vymezit odpov\u011bdnost n\u011bkter\u00e9ho z&nbsp;ministerstev za oblast n\u00e1rodn\u00ed infrastruktury pro prostorov\u00e9 informace s&nbsp;ohledem na pot\u0159ebu alokovat pro tuto problematiku pot\u0159ebn\u00e9 finan\u010dn\u00ed prost\u0159edky ze st\u00e1tn\u00edho rozpo\u010dtu.<\/p>\n\n\n\n<p><strong>Z\u00e1kon \u010d. 200\/1994 Sb., o zem\u011bm\u011b\u0159ictv\u00ed <\/strong>vymezuje jednotliv\u00e9 zem\u011bm\u011b\u0159ick\u00e9 \u010dinnosti, kter\u00e9 jsou bu\u010fto samy o sob\u011b po\u0159izov\u00e1n\u00edm \u010di zpracov\u00e1v\u00e1n\u00edm prostorov\u00fdch dat nebo s&nbsp;prostorov\u00fdmi daty souvis\u00ed. Z\u00e1kon upravuje pr\u00e1va a povinnosti p\u0159i v\u00fdkonu zem\u011bm\u011b\u0159ick\u00fdch \u010dinnost\u00ed, konkr\u00e9tn\u011b v \u00a7 6 ukl\u00e1d\u00e1 povinnost ke sd\u00edlen\u00ed a poskytov\u00e1n\u00ed prostorov\u00fdch dat, d\u00e1le upravuje ov\u011b\u0159ov\u00e1n\u00ed v\u00fdsledk\u016f zem\u011bm\u011b\u0159ick\u00fdch \u010dinnost\u00ed a geodetick\u00e9 referen\u010dn\u00ed syst\u00e9my a st\u00e1tn\u00ed mapov\u00e1 d\u00edla.<\/p>\n\n\n\n<p><strong>Vyhl\u00e1\u0161ka \u010d. 31\/1995 Sb., kterou se prov\u00e1d\u00ed z\u00e1kon \u010d. 200\/1994 Sb., o zem\u011bm\u011b\u0159ictv\u00ed<\/strong>. Jde sp\u00ed\u0161e o technickou normu stanovuj\u00edc\u00ed podm\u00ednky spr\u00e1vy a poskytov\u00e1n\u00ed prostorov\u00fdch dat ve ve\u0159ejn\u00e9m z\u00e1jmu org\u00e1ny st\u00e1tn\u00ed spr\u00e1vy na \u00faseku zem\u011bm\u011b\u0159ictv\u00ed. Z&nbsp;hlediska \u00favah o budouc\u00ed podob\u011b n\u00e1rodn\u00ed infrastruktury pro prostorov\u00e1 data je mo\u017en\u00e9 vyu\u017e\u00edt tohoto prov\u00e1d\u011bc\u00edho p\u0159edpisu a doplnit dal\u0161\u00ed podrobnosti ohledn\u011b formy poskytov\u00e1n\u00ed dat, roz\u0161i\u0159ov\u00e1n\u00ed dat apod.<\/p>\n\n\n\n<p><strong>Z\u00e1kon \u010d. 139\/2002 Sb., o pozemkov\u00fdch \u00faprav\u00e1ch a pozemkov\u00fdch \u00fa\u0159adech, <\/strong>gestorem je Ministerstvo zem\u011bd\u011blstv\u00ed. Je t\u0159eba se zam\u011b\u0159it na lep\u0161\u00ed vyu\u017eit\u00ed prostorov\u00fdch dat po\u0159\u00edzen\u00fdch v&nbsp;r\u00e1mci pozemkov\u00fdch \u00faprav a d\u00e1le nevyu\u017e\u00edvan\u00fdch a nesd\u00edlen\u00fdch.<\/p>\n\n\n\n<p><strong>Z\u00e1kon \u010d. 219\/2000 Sb., o majetku \u010cR a jej\u00edm vystupov\u00e1n\u00ed v&nbsp;pr\u00e1vn\u00edch. <\/strong>Jako nutn\u00e9 se jev\u00ed p\u0159ijet\u00ed na\u0159\u00edzen\u00ed vl\u00e1dy specifikuj\u00edc\u00ed prostorov\u00e1 data a informace a nakl\u00e1d\u00e1n\u00ed s&nbsp;nimi dle \u00a7 14a tohoto z\u00e1kona a v&nbsp;r\u00e1mci NIPI po\u010d\u00edtat se za\u010dlen\u011bn\u00edm tohoto registru, kter\u00fd je napln\u011bn a jeho\u017e data by mohla slou\u017eit jako podklad pro dal\u0161\u00ed \u010dinnost ve\u0159ejn\u00e9 spr\u00e1vy.
